Legal Experience
Joe Davis is Board Certified by the Texas Board of Legal Specialization in Civil Trial Law and is part of our business litigation section. He represents commercial, construction, real estate and oil and gas clients in the areas of litigation, arbitration, mediation, and negotiation.
Specific Matters of Representation
Mr. Davis represents Developers, Contractors, Design Professionals, Subcontractors, Suppliers and Owners in negotiation of construction contracts and in litigation, arbitration and mediation of construction-related disputes, such as:
- Defense of engineering firm through summary judgment in suit by Contractor on highway project seeking $6 million in damages from alleged design defects and negligent misrepresentation
- Litigation, mediation and settlement of construction defect claims on behalf of City against Design Professionals, Contractor and Subcontractors for City Hall Building
- Negotiation on behalf of Community College District with Construction Manager of deductive changes in $100 million campus construction program
- Defense of engineering firm through mediation and settlement of suit by Developer over alleged defects in subdivision infrastructure design
- Litigation, mediation and settlement of construction defect and mold related claims on behalf of Condominium Homeowners Association and 76 individual condominium unit owners against Developer, General Contractor, Subcontractors and Homeowners Insurance Carrier
- Negotiation of design-build special events center project for Central Texas municipality
- Litigation on behalf of General Contractor through jury trial of construction defect and payment dispute with Owner over taxi service headquarters building
- Litigation on behalf of General Contractor through jury trial of dispute with Subcontractor over claimed breach of contract on Visitor Information Center project
Mr. Davis represents Operators, Royalty Owners and Pipelines in a wide variety of oil and gas-related disputes, such as:
- Defense of pipeline company in litigation, mediation and settlement of landowner's challenge to right-of-way for international natural gas pipeline in Texas-Mexico border county, including temporary injunction claims and claims for damages for alleged bad-faith trespass
- Defense of pipeline company through trial and appeal of producers' take-or-pay claims
- Defense of Operator of unitized field in South Texas in litigation, mediation and settlement of seismic vibration property damage claims brought by over 1,000 plaintiffs
- Defense through summary judgment of claims against Operator for damages from gas well blow-out and fire
- Leadership of multi-district litigation in defense of garnishment claims against several Delaware corporations doing business with government-owned oil and gas corporation in the far east.
