Legal Experience
Mr. Weatherford focuses his practice on clients doing business in the health care industry. His clients include hospital systems, physicians, behavioral health centers, pharmacies, and other health care providers. Representation of these clients includes advising them with respect to reimbursement, transactional, compliance, and regulatory matters.
Specific Matters of Representation
- Advising hospitals with respect to Medicaid and Medicare reimbursement issues including: Medicaid and Medicare disproportionate share hospital, Medicaid standard dollar amount, Medicaid managed care, Medicare + Choice, and Medicaid Waiver Program funding.
- Representing health care entities, including hospitals, physicians, and other providers, in connection with complex business transactions.
- Developing and implementing policies and procedures to ensure that health care providers comply with state and federal requirements related to Medicaid, Medicare, charity care reporting, the Emergency Medical Treatment and Active Labor Act, the Health Insurance Portability and Accountability Act and its Administrative Simplification regulations, discounting, fraud and abuse, and other state and federal statutes and regulations.
- Drafting and negotiating, on behalf of hospitals, doctors, and other providers, managed care contracts and other types of payment arrangements.
- Successfully representing providers in litigation to enforce payment obligations under managed care contracts and other types of payment arrangements.
- Representing health care providers in government investigations and ensuing administrative and civil actions, defense of whistle blower actions, internal investigations, claims audits, business operations reviews, and establishing and maintaining compliance programs and processes.
- Monitoring state and federal legislative and regulatory initiatives related to the health care industry and advising health care providers of the potential ramifications of same.
- Drafting and interpreting medical staff bylaws.
- Advising non-profit charitable organizations in regard to corporate and compliance issues related to the maintenance of their tax-exempt status.
