Clean air is important not only to regulators but to the entire public. The Clean Air Act ("CAA") governs air quality issues at the federal level. The CAA has generated a great deal of ongoing recent debate, much of which is based on conflicting opinions relating to public health and scientific evidence.  Our attorneys help our clients navigate these complex issues and respond to permit, compliance, and enforcement challenges.

We are well-positioned to counsel our clients on Texas air quality laws. As a staff attorney for the former Texas Air Control Board and TNRCC (now the TCEQ), Rod Johnson, a partner at Brown McCarroll, handled air quality permitting, rulemaking, and administrative and civil judicial enforcement matters. His experience includes serving as the former enforcement coordinator for all air quality enforcement matters in the Legal Services Division. This gives Rod unique insight from which to represent our clients on air quality issues.

Our air quality team has particular experience with:

  • Air quality audits
  • Compliance strategy
  • Permitting
  • NSR and New Source Performance Standards ("NSPS")
  • Title V operating permits and reporting
  • Preparing comments to proposed rulemaking and legislation
  • Administrative and civil enforcement matters
