Compliance

Whether the issue relates to air, water, or waste issues, you have one ultimate concern: complying with the law so that you can accomplish your goals and minimize your risk.

We understand compliance is not always easy given the number and complexity of local, state, and federal laws that may be applicable. Our attorneys deal with environmental regulations and statutes every day and are available to help you put together a strategy to minimize risks and unexpected delays.

When moving forward on a new project, you want to make sure that you are in compliance with federal, state, and local requirements.  Our attorneys are skilled at understanding the intricacies of environmental regulations and have experience counseling clients on compliance in many areas, including hazardous and municipal solid waste, air and water quality, injection wells, in situ uranium mining, underground and aboveground storage tanks, water and wastewater utilities, and pipelines.

Although not strictly a traditional environmental issue, we also represent clients before the Occupational Safety and Health Administration ("OSHA") on compliance and enforcement activities involving, among other areas, process safety management ("PSM") compliance.

Enforcement

When you face an enforcement action, you want to resolve it as quickly as possible.

Leveraging decades of experience, our attorneys can assess an enforcement action promptly and counsel you on your options.

We are familiar with the tendencies of the various enforcement agencies and regulators and can help you determine your best settlement approaches.

When necessary or when it is in your best interest, we also have the experience and skill to represent you in challenging such enforcement actions.

Strategic Planning

Environmental issues can throw a wrench into acquiring or selling real property, assets, or companies. Our attorneys assist our clients in avoiding unnecessary delays and frustration of projects through comprehensive advance planning. Strategic Planning may include environmental assessments, audits, structuring documents and transactions to protect your interests, and anticipating potential issues down the road.

We often work with our corporate & securities and real estate groups to help clients through environmental issues and provide the due diligence to get their deals done.
