Seeking a permit or going up against a challenge to a permit can be time-consuming and hinge on many different issues.

Some permits, such as those required for new electric power generating plants or municipal solid waste landfills, are hotly contested. Non-governmental organizations, the Environmental Protection Agency (EPA), and the general public are just a few of the parties that may have significant concerns.  Our attorneys have experience securing permits on behalf of clients on a variety of different types of projects, some of which are described on our contested proceedings page.

We have a wealth of experience helping manufacturing and utility clients obtain permits or other authorizations. We understand our clients’ technology, so we can negotiate permit terms and conditions that provide operational flexibility and minimize the need for later modifications.  We are also very experienced in successfully obtaining approvals for project sitings, which can include local, state, and federal authorizations or requirements.  We were successful in obtaining approvals for siting near Sweetwater, Texas, of one of the largest wind turbine fields in North America.  In addition, we were successful in getting site approval for and defending against state and federal judicial and administrative challenges to a large wind turbine project located on the Texas Gulf Coast between Corpus Christi and Brownsville.

Our attorneys are also out in front of rule changes to ensure that we are representing our clients interests to the fullest extent. Most recently, we assisted in preparation of comments on behalf of one of our clients relating to a rulemaking initiative by the Railroad Commission of Texas on injection and storage of CO2 in oil and gas reservoirs.
