Practices » Specialty Issues

In addition to representing general practitioners and general hospitals, our attorneys advise many specialized health care providers.

Long-term Care

As the baby boomer generation ages and improved health care leads to longer life, the long-term care industry continues to grow. Our attorneys have represented owners, operators, and managers in virtually every aspect of long-term care, including regulation, business transactions, and patient care issues. We have worked with clients at every level of long-term care – long-term acute care hospitals, rehabilitation hospitals, independent living, assisted living, skilled nursing, home health agencies – and understand the different challenges at each level.

We help our clients with a variety of issues and steps in setting up such facilities, including:

  • Negotiation of physician and staff contracts
  • Equipment purchases
  • Admission agreements
  • Drafting policies
  • Contract disputes
  • Day-to-day operational issues

A key member of our team previously worked as the Chief of the Elder Law Section in the Texas Attorney General’s Office, and later as the Assistant Commissioner of the Texas Department of Human Services, heading up its Long-Term Care Regulatory program. Another attorney served as General Counsel to the Texas Senate Health and Human Services Committee and as Director of the Texas Senate’s Interim Committee on Home Health and Assisted Living Facilities.

Nonprofits

Non-profit health care providers rely on us to help preserve their 501(c)3 tax exemption in business combinations. We also give tax-exempt organizations guidance in structuring physician recruitment packages in order to avoid private inurement or impermissible private benefit sanctions.

Other Specialty Areas of Emphasis

Our attorneys have specific experience with many other medical specialty areas. Examples of projects with health care specialties that we have worked with include:

  • Creating concierge medical practices across the country;
  • Forming and negotiating coverage agreements for Anesthesiology Groups in several states;
  • Assisting an orthopedic surgery group in developing a specialty hospital, obtaining a  certificate of need, structuring centers of excellence arrangements with device manufacturers, and addressing reimbursement disputes with payors;
  • Navigating the unique compliance issues faced by pain management providers;
  • Forming and syndicating ambulatory surgery centers across the nation;
  • Representing behavioral health providers facing licensure and Medicare certification termination;
  • Obtaining funding for start up health care ventures including funding for a new medical device manufacturer.

Because of our experience working with these specialty areas, we have knowledge of the unique challenges you face and are able to provide tailored solutions to help you resolve them and position your business for the future.
